("SeafoodByNet.com"), its subsidiaries and affiliates, including SeafoodByNet.com. IF YOU VISIT OR SHOP AT THE SITE, YOU ACCEPT THESE TERMS OF SALE.

These terms of Sale ("Terms of Sale") apply to all sales at the web site located at www.SeafoodByNet.com (the "Site"), and all associated sites and phone numbers linked to the Site by ALLSEAFOOD.COM, INC. DBA SeafoodByNet.com DBA Two Tails Marker/Eatery DBA Java Planet Coffee/Internet Café (collectively and hereafter "SeafoodByNet.com"). IF YOU VISIT OR SHOP AT THE SITE, YOU ACCEPT THESE TERMS OF SALE.

Additional terms and conditions apply to purchases of goods and services at the Site ("Terms"), all of which Terms are made a part of these Terms of Sale by this reference. If there is a conflict between these Terms of Sale and the Terms, these Terms of Sale shall control with respect to your purchase.

Hours of Operation

The SeafoodByNet.com Team is generally available to assist you Monday through Friday, 9am-5pm, Central Standard Time, excluding U.S. Federal holidays ("Regular Business Hours").
If you have a question about a product we offer or would like assistance with a new order, our knowledgeable sales staff is available by calling 1-888-602-1394, during regular business hours. You may also send an e-mail to Sales@SeafoodByNet.com. Upon receipt of your e-mail, SeafoodByNet.com will send an auto-reply e-mail to confirm receipt, followed by a response from a sales representative, typically within 24 Regular Business Hours of the auto-reply e-mail. If you have already placed an order and have questions concerning order status, tracking, Customer Service Representatives can be reach during our Regular Business Hours by calling 1-888-602-1394. Resale or Export

SeafoodByNet.com reserves the right to refuse or cancel your order if SeafoodByNet.com suspects you are purchasing for unauthorized resale or export.

Payment Methods

SeafoodByNet.com allows you to make your purchases using any of the payment methods described below.
All transactions are performed in USD currency. When you order online, you may pay by credit, debit, or check card. When you provide SeafoodByNet.com with card information, SeafoodByNet.com will obtain a pre-approval from the card company for the amount of the order, which may result in a corresponding block on your available credit while the pre-approval remains in place. SeafoodByNet.com will not bill your credit card or process a transaction until your order ships. SeafoodByNet.com accepts American Express, Discover, MasterCard, and Visa Credit, debit, or check cards.
Debit cards and check cards have a daily spending limit that may substantially delay the processing of your order; please contact your bank for more information. Credit/Debit card orders require billing address verifications. If ship-to address is different from your billing address, this address is also subject to verification. An incorrect or unverifiable billing or ship-to address puts the order into a hold status until address is verified. At SeafoodByNet.com's discretion, your order may be cancelled. If credit/debit card authorization is declined, your order is put on hold until a successful authorization is obtained. At SeafoodByNet.com's discretion, your order may be cancelled. Under certain circumstances, SeafoodByNet.com may issue SeafoodByNet.com Store Credits that have restrictions, including a specific expiration date or restriction on the type of product. Should any restrictions exist, SeafoodByNet.com will clearly communicate them to the customer at the time of issuance of the SeafoodByNet.com Store Credit.

Order Processing and Pricing

Shipment dates on your order are based on product availability, payment processing time, and warehouse processing time and do not include transit time. SeafoodByNet.com does not begin order processing until SeafoodByNet.com receives all of the information that it needs and full payment or a full authorization, in the case of credit/debit card. SeafoodByNet.com may begin payment processing for orders placed on weekends or holiday on the next business day. SeafoodByNet.com reserves the right to charge prices for the product displayed on-line at any time and particularly to correct pricing error. SeafoodByNet.com is not responsible for typographical errors. SeafoodByNet.com reserves the right to cancel any order you have placed if there was a typographical error on the Site concerning the pricing or availability of any item you have ordered when you placed the order. Your total order price will include the price of the product on the day of shipping plus any applicable sales tax and shipping charges. In the event of a price decrease prior to your order fulfillment, the lower price will be automatically applied to your order. In the rare event that higher price is required for a selected product, you will be contacted for approval before SeafoodByNet.com processes your order. Due to variance in weight of consumable products, some items ordered are subject to minor variation in final total weight. Effected items will have such product variation noted on the items in your shopping cart prior to checkout, product page, and as well as on the automatic confirmation email. SeafoodByNet.com reserves the right to charge the customer for the actual weight of product at the time of shipment.
Items in the following weight categories:
    0-2 LBS.= 10% under/ 50% over
    2-10 LBS.= 20% under/over
    10+ LBS.= 10% under/over
The amount billed on your final invoice will reflect the actual weight of items ordered, as subject to the variation. Please note that SeafoodByNet.com makes every effort to meet the exact weight as precisely as possible.

Sales Tax

Purchasers are responsible for any and all federal, state, and local taxes arising out of the sale of the products or services through the Site. In addition to the price of your purchases, SeafoodByNet.com may charge you sales tax based on your shipping address and the sales tax rate in effect at the time your order is billed.
All orders shipping or billed within Illinois are subject to the 1.75% Illinois State Retail Tax.

Shipping

Unless otherwise noted, shipping and handling charges will be shown as additional charges on your invoice. For an additional charge, SeafoodByNet.com offers expedited shipping options on most SeafoodByNet.com's products. As the delivery of your order is beyond SeafoodByNet.com's control once your order leaves SeafoodByNet.com facilities, SeafoodByNet.com cannot assume liability for late deliveries, regardless of the delivery method you specify. At this time International Shipping is not available. Free Shipping applies to our standard deliveries to most addresses in the 48 contiguous states, for orders exceeding $299 dollars. All orders are shipped signature released-No signature required. This means that if no one is there to receive the order from UPS/FedEx, the driver will leave the order at the door. This signifies acceptance of the order. We highly recommend that someone is there within the designated timeframe to accept delivery of the order and promptly refrigerate it. We recommend the use of the UPS/FedEx tracking number (we will e-mail you the tracking number when the order shipped), to monitor the delivery of your order.
If this is a gift, please be sure to alert the recipient that something perishable is coming via UPS/FedEx and to try and make arrangements to accept delivery and immediately refrigerate it upon receipt.
WE CANNOT GUARANTEE SPECIFIC DELIVERY TIMES. WE ARE NOT LIABLE FOR ORDERS THAT ARE NOT RETRIEVED IN A TIMELY MANNER. THE COURIER WILL NORMALLY KNOCK ON YOUR DOOR AND, IF NO ONE ANSWERS, WILL LEAVE YOUR PACKAGE AT YOUR DOOR.

Force Majeure

SeafoodByNet.com shall not be liable for any losses, damages, or costs resulting from a delay caused by circumstances beyond SeafoodByNet.com's control, including but not limited to, acts of God, floods, acts of war or terrorism, strikes, material or labor shortages, accidents and other disasters, riot or insurrections, embargoes, or other related delays in transportation.

Incomplete or Damaged Shipments; Exchanges

If you receive a shipment that is incomplete, incorrect, or physically damaged, this must be reported to SeafoodByNet.com within 48 hours of shipment receipt.
